FLORIDA ROAD ALERT:

CRITICAL SURGE IN ELECTRIC SCOOTER CRASHES AND
VICTIMS' LEGAL RIGHTS

Electric scooter rider in Florida

FLORIDA — The use of electric scooters (e-scooters) has become an essential urban mobility alternative throughout the Sunshine State. However, this surge has been accompanied by an alarming increase in severe traffic accidents, leaving riders completely vulnerable against cars, SUVs, and commercial trucks.

CRITICAL STATISTICS: THE IMPACT ON
TRAUMA CENTERS

Hospital reports across South Florida, including Memorial Healthcare System, have recorded increases of up to 178% in emergency admissions linked to micromobility. With more than 80% of riders operating without a helmet, collisions with larger vehicles often result in traumatic brain injuries, multiple fractures, and permanent disabilities.

WHAT DOES FLORIDA LAW SAY ABOUT E-SCOOTERS?

Under Florida Statute (316.2128), electric scooter operators have virtually the same rights and responsibilities as bicyclists. This means:

1. They have the legal right to share public roadways with speed limits of 30 mph or less and to use designated bicycle lanes.
2. Drivers of cars and trucks have a legal obligation to respect their space and yield the right-of-way according to traffic rules.

Despite this, many insurance companies attempt to minimize claims or unfairly blame the victim, taking advantage of the lack of public awareness surrounding local regulations in cities like Miami, Tampa, or Sarasota.
